Terms & Conditions

Straw Hat Stucco & Stone LLC – Serving Colorado with Excellence in Stucco, EIFS, and Stone Veneer

These terms outline the conditions under which all work is performed by Straw Hat Stucco & Stone LLC (“Straw Hat”). By accepting an estimate or entering into a contract with us, you agree to the following:

General Agreement

At Straw Hat Stucco & Stone, all work is governed by a written contract to ensure clarity, fairness, and quality in every project. These terms protect both parties and help maintain the integrity of every job we perform. Every job or project will have its own dedicated contract, which will include these or additional terms and conditions tailored to the specific scope of work.

Project Scope & Pricing

  • All estimates are based on current plans or site measurements and are subject to adjustment upon final field verification.

  • Pricing is valid for 120 days from the date of proposal. After this period, quotes may be revised based on material and labor cost changes.

  • Work must proceed in a continuous, uninterrupted manner. Delays not caused by Straw Hat may result in a $65/hour trip charge (1-hour minimum).

Scheduling & Payments

  • A formal contract and project schedule will be drafted and signed before work begins.

  • Payment schedule: 50% due at completion of lath; 50% upon completion of finish.

  • Full payment is due upon substantial completion. Outstanding work in non-essential areas (e.g., columns, walls, fences) is not a valid reason for withholding final payment.

  • Warranty repairs will commence only after full payment is received.

Material Use & Limitations

  • We use only high-quality materials, sourced through trusted suppliers with whom we have built long-term relationships.

  • Color samples are approximate. Final color may vary due to weather, application method, and batching.

  • Minor hairline cracking is typical in all cementitious stucco systems and is not considered a defect.

  • Cracks caused by structural movement or shifting are not covered under warranty and must be repaired at the client’s expense.

Alterations & Damages

  • Any change in scope must be approved in writing and may impact project cost and timeline.

  • Straw Hat is not responsible for damage caused by others (subcontractors, site visitors, etc.). Repairs to such damage will be billed separately.

  • All claims must be submitted in writing within 48 hours of the incident. Straw Hat requires 10 business days to inspect and respond.

Obstructions & On-Site Property

  • For jobs involving landscaping, wall décor, cameras, lighting systems, heaters, jacuzzis, or other features that may obstruct access or be vulnerable to incidental contact, we will take every precaution to avoid disturbance.

  • However, Straw Hat is not liable for damage to these features unless caused by clear negligence. Clients are encouraged to remove or protect such items before work begins.

Weather Conditions

  • No work will be performed if temperatures are forecasted to fall below 30°F within 24 hours unless explicitly directed by the client.

  • Any work done under such conditions without proper tenting or heating voids the standard warranty.

  • Tenting or heating services must be agreed upon in advance and will result in additional charges.

Clean-Up & Waste Removal

  • We place all construction debris in a trash container provided on-site by the client or general contractor.

  • Final removal and disposal of trash is the responsibility of the client unless otherwise specified.

Permits & Inspections

  • All permits are to be secured by the contractor or homeowner unless specifically stated in the agreement.

  • The client is responsible for calling inspections and notifying Straw Hat when work may begin or continue.

Warranty Limitations

  • Patching, fogging, and color blending are covered under our limited warranty and will be addressed within the scope of the original project.

  • Color inconsistencies, cracks due to natural causes, or non-structural aesthetic changes are not covered.

Legal Protection

  • In the event of non-payment, breach of contract, or delay caused by a homeowner, builder, or contractor, Straw Hat will issue formal notice.

  • If the issue is unresolved, we will pursue legal action through any means available, including lien filing, court litigation, and collections.

  • All work and agreements are legally enforceable. We reserve the right to seek full compensation, recovery of legal fees, and damages.

By proceeding with a Straw Hat Stucco & Stone project, you acknowledge these Terms & Conditions and accept responsibility for compliance. These policies are in place to ensure successful, professional, and timely project execution for all parties involved. Each signed contract will include these terms and may include additional provisions as required by the specific project.
